Who Can Use Memorial Fund

You must be at least 18 years old to create a fund, manage a fund, or give a gift.

If you use Memorial Fund on behalf of a family or group, you confirm you have their permission to do so.

What Memorial Fund Is

Memorial Fund is an online tool. It lets families create a memorial page and collect gifts from friends and loved ones.

We are not a charity, a bank, a lawyer, or a financial advisor. We do not give financial, tax, or legal advice. Our guides are general information only.

Payments are processed by Stripe. Gifts go to the bank account connected to the fund through Stripe. We never hold the money.

Gifts Are Not Tax-Deductible

Gifts go to a family, not a charity. They cannot be deducted on your taxes.

Fees

Creating a fund is free. Each gift has card processing fees charged by Stripe and a 1% Memorial Fund platform fee. Donors can choose to cover these fees.

We show every fee before a gift is made. If our fees change, we will update this page and tell fund managers first.

If You Create or Manage a Fund

You agree to:

• Tell the truth about who the fund honors and how the money will be used.
• Use the money the way you describe on the fund page.
• Accept Stripe's terms for connected accounts so gifts can reach the bank account you choose.
• Keep your sign-in secure and only invite managers you trust.
• Handle any taxes or reporting that apply to money you receive. Talk to a tax professional if you are unsure.

You are responsible for the fund you create and for the people you invite to manage it.

If You Give a Gift

Gifts are final once they are made. If you believe a gift was a mistake or a fund is not genuine, let us know through our Contact page. We will look into it. Refunds are made at the fund manager's choice, or by us when we find fraud or a violation of these terms.

If you give anonymously, your name is hidden on the public page. Fund managers can still see it so they can thank you.

Your Content

You own the words, photos, and memories you post. You give us permission to display them on Memorial Fund and in sharing previews so the fund can work.

Only post content you have the right to share. Follow our Community Guidelines. We may remove content or funds that break these terms or the guidelines.

Ending Your Use

You can close a fund at any time. We may suspend or remove a fund or account that breaks these terms, puts others at risk, or appears to be fraudulent.

Disclaimers

We work hard to keep Memorial Fund reliable, but it is provided as is. We cannot promise it will always be available or error free. We do not verify every statement made on a fund page.

Limits on Our Liability

To the extent the law allows, Memorial Fund is not liable for indirect or unexpected losses. Our total liability for any claim is limited to the platform fees you paid us in the 12 months before the claim, or $100, whichever is more.

You agree to cover our reasonable costs if a claim is brought against us because of content you posted or a fund you ran in violation of these terms.

Resolving Disagreements

If you have a problem, reach out through our Contact page first. Most issues can be fixed quickly and informally.

If we cannot resolve it within 60 days, you and Memorial Fund agree to settle it through binding individual arbitration, not in court. Either of us may instead bring a claim in small claims court. Claims must be brought individually, not as part of a class action. You may opt out of arbitration by telling us through our Contact page within 30 days of first agreeing to these terms.

These terms are governed by the laws of the State of Colorado.

Changes to These Terms

We may update these terms. If we make an important change, we will post it here and update the date at the top. Continuing to use Memorial Fund after a change means you accept it.
